On 24 July 2007 the Environmental Protection Agency prosecuted Marley Compost Limited at Monaghan District Court. The Company pleaded guilty to five charges all of which related to its failure to provide infrastructure for the control of odours within the timeframes required by the licence.
On hearing details of the offences Judge Sean McBride imposed fines of €2,500 and EPA costs of €7,859 were also awarded.
