On 6 March 2008 the Environmental Protection Agency prosecuted Ray Whelan Limited at Carlow District Court. The Company pleaded guilty to:
• Failing to install required infrastructure within specific timeframes.
• Failing to submit a report to the EPA.
On hearing details of the offences from an EPA Inspector, Judge William Harnett imposed a fine of €1,500 and EPA costs of €7,320 were also awarded.
