On 2nd October 2020 the Environmental Protection Agency prosecuted Dairygold Co-operative Society Limited, Castlefarm Centre and Clonmel Road Centre, Mitchelstown, County Cork at Fermoy District Court.

Dairygold Co-operative Society Limited pleaded guilty to breaches of conditions of its Industrial Emissions Licence (P0404-02) by:

Failing to comply with Condition 5.1 of its Industrial Emissions Licence, in that specified emissions from the installation exceeded the emission limit values set out in Schedule B: Emission Limits of the licence at discharge point reference no. SWD/CF-1 to the River Gradoge, between the 12th and 13th day of November 2018 inclusive.

Failing to comply with Condition 11.1 of its Industrial Emissions Licence, in that the company failed between the 12th and 29th day of November 2018 inclusive to notify the Agency as soon as practicable after the occurrence of:
(a) any emission which does not comply with the requirement of the licence, and
(b) any incident with the potential for environmental contamination of surface water.

Failing to comply with Condition 9.3.1 of its Industrial Emissions Licence, in that the company failed on the 12th day of November 2018 where an incident occurred, to immediately isolate the source of the emission and evaluate the environmental pollution.
Judge Sheridan convicted Dairygold Co-operative Society Limited on all charges and imposed a fine of €2,000 on each of the charges. Agency costs were also awarded.
