EPA Prosecutes KMK Metals Recycling Limited (W0113-04)

On the 17th of February 2020, the Environmental Protection Agency prosecuted KMK Metals Recycling Limited, Cappancur, Tullamore, Co Offaly at Tullamore District Court. The case was taken for failure of KMK Metals Recycling Limited to comply with conditions of its Industrial Emissions Licence (W0113-04).
KMK Metals Recycling Limited pleaded guilty to the following four charges:
That contrary to Condition 5.1 of its licence
- on the 31st of October 2018, specified emissions from the facility exceeded the emission limit value set out in Schedule B.2 of the Licence, to wit, suspended solids contained in storm water run-off at the emission point reference number DX.
- on the 30th of November 2018, specified emissions from the facility exceeded the emission limit value set out in Schedule B.2 of the Licence, to wit, total phosphorous contained in treated sanitary waste water at the emission point reference number F.
- on the 30th of April 2019, specified emissions from the facility exceeded the emission limit value set out in Schedule B.2 of the Licence, to wit, mineral oil containing in storm water run-off at the emission point reference number DX.
- on the 27th of June 2019, specified emissions from the facility exceeded the emission limit value set out in Schedule B.2 of the Licence, to wit, total phosphorous contained in treated sanitary waste water at the emission point reference number F.
Judge Staines heard the evidence and convicted KMK Metals Recycling Limited on all charges and imposed fines of €2,000 per charge. Agency costs of €6,822.00 were also awarded.
