DPP prosecutes a former director of a Waste Company W0047

On 14th of November 2022 at The Criminal Courts of Justice in Dublin, the Director of Public Prosecutions prosecuted a former director of a waste company for disposing of or undertaking the recovery of waste at a facility otherwise than under and in accordance with a licence contrary to Sections 9, 10, 39(1) 39(9) of the Waste Management Act 1996 and of holding, transporting, recovering or disposing of waste in a manner that causes or is likely to cause environmental pollution contrary to those same sections of the Waste Management Act 1996.

The former director was charged with the following three offences:  

 

  • That between the 1st October, 2003 and the 26th September, 2006, both dates inclusive, being a director of Nephin Trading Limited, he disposed of or undertook the recovery of waste at a facility at Kerdiffstown in the county of Kildare, otherwise than under and in accordance with a waste licence (W0047-01) that was then in force in relation to the carrying on of the activity concerned at that facility, by accumulating a mound of waste in the northwest area of that facility.

 

  • That between the 27th September, 2006 and the 25th November, 2008, both dates inclusive, being a director of Nephin Trading Limited, he disposed of or undertook the recovery of waste at a facility at Kerdiffstown in the county of Kildare, otherwise than under and in accordance with a waste licence (W0047-02) that was then in force in relation to the carrying on of the activity concerned at that facility, by accumulating a mound of waste in the northwest area of that facility.

 

  • That between the 1st October 2003 and the 25th November 2008, both dates inclusive, being a director of Nephin Trading Limited, at a waste facility at Kerdiffstown in the county of Kildare, he held transported, recovered or disposed of waste in a manner that caused or was likely to cause environmental pollution.

 

Judge Greally convicted him on all of the above three charges and on the 9th June 2023 he was sentenced to 3 years imprisonment, with 12 months suspended.
