EPA prosecutes Uisce Éireann – Boherbue (D0437-01)

On 27th February 2023, the Environmental Protection Agency prosecuted Uisce Éireann (Boherbue) at Dublin Metropolitan District Court.
Uisce Éireann pleaded guilty to breaches of conditions of its Waste Water Discharge Licence – D0437-01) by:
- Failure to comply with Condition 3.3 on or about the 17th of August 2017, in that one or more specified discharges from the waste water works exceeded the emission limit values for Ammonia as set out in Schedule A: Discharges and Discharge Monitoring, of the said Licence.
- Failure to comply with Condition 3.3 on or about the 17th of May 2018, in that one or more specified discharges from the waste water works exceeded the emission limit values for Ammonia as set out in Schedule A: Discharges and Discharge Monitoring, of the said Licence.
- Failure to comply with Condition 3.3 on or about the 19th of July 2018, in that one or more specified discharges from the waste water works exceeded the emission limit values for Ammonia as set out in Schedule A: Discharges and Discharge Monitoring, of the said Licence.
- Failure to comply with Condition 3.3 on or about the 6th of February 2019, in that one or more specified discharges from the waste water works exceeded the emission limit values for Ammonia as set out in Schedule A: Discharges and Discharge Monitoring, of the said Licence.
- Failure to comply with Condition 3.3 on or about the 17th of August 2017, in that one or more specified discharges from the waste water works exceeded the emission limit values for Orthophosphates as set out in Schedule A: Discharges and Discharge Monitoring, of the said Licence.
- Failure to comply with Condition 3.3 on or about the 19th of July 2018, in that one or more specified discharges from the waste water works exceeded the emission limit values for Orthophosphates as set out in Schedule A: Discharges and Discharge Monitoring, of the said Licence.
- Failure to comply with Condition 3.3 on or about the 2nd of August 2018, in that one or more specified discharges from the waste water works exceeded the emission limit values for Orthophosphates as set out in Schedule A: Discharges and Discharge Monitoring, of the said Licence.
- Failure to comply with Condition 3.3 on or about the 24th of January 2019, in that one or more specified discharges from the waste water works exceeded the emission limit values for Orthophosphates as set out in Schedule A: Discharges and Discharge Monitoring, of the said Licence.
Judge Halpin,having heard the evidence convicted Uisce Éireann on charge one above and imposed a fine of €1,000. He took all other charges into consideration. Costs were also awarded
