DPP Prosecutes Killarney Waste Disposal Unlimited Company (W0217-01)

Hearing Date: March 13, 2024

On 13th of March 2024 at Tralee Circuit Criminal Court, following an investigation by the Environmental Protection Agency, the Director of Public Prosecutions prosecuted Killarney Waste Disposal Unlimited Company (W0217-01) in relation to its facility at Aughacurreen, Killarney, Co Kerry. 

Killarney Waste Disposal Unlimited Company pleaded guilty to:  

  • In the year of 2013, it disposed of or undertook the recovery of waste at a facility otherwise than in accordance with a waste licence, Register Reference Number W0217-01 under the Waste Management Act, 1996, as amended that was in force in relation to the carrying on of the activity concerned at that facility contrary to Section 39(1) and Section 39(9) of the Waste Management Act, 1996, as amended by accepting waste in excess of the annual limit of 40,000 tonnes per annum in breach of Condition 1.2 and Schedule A of the said licence.
  • In the year of 2014, it disposed of or undertook the recovery of waste at a facility otherwise than in accordance with a waste licence, Register Reference Number W0217-01 under the Waste Management Act, 1996, as amended that was in force in relation to the carrying on of the activity concerned at that facility contrary to Section 39(1) and Section 39(9) of the Waste Management Act, 1996, as amended by accepting waste in excess of the annual limit of 40,000 tonnes per annum in breach of Condition 1.2 and Schedule A of the said licence.

On the 13th of November 2024, Judge Behan convicted Killarney Waste Disposal Unlimited Company on the above charges and imposed fines totalling €500,000. Costs were also awarded.
