DPP Prosecutes Aurivo Dairy Ingredients Limited (P0802-03)

On 27th of March 2025 at Sligo Circuit Criminal Court, following an investigation by the Environmental Protection Agency, the Director of Public Prosecutions prosecuted Aurivo Dairy Ingredients Limited (P0802-03) in relation to its facility at Dublin Road, Ballaghaderreen, County Roscommon.

Aurivo Dairy Ingredients Limited pleaded guilty to breaches of conditions of its Industrial Emissions Licence - (P0802-03) by:

  • Count No. 1:  Failing to comply with Condition 5.3, on the 16th August 2022, in that odours from the activities carried on at their site, resulted in an impairment of, or interference with amenities or the environment beyond their installation boundary or any other legitimate uses of the environment beyond said boundary.
  • Count No. 7:   Failing to comply with Condition 5.3, on the 21st September 2022, in that odours from the activities carried on at their site, resulted in an impairment of, or interference with amenities or the environment beyond their installation boundary or any other legitimate uses of the environment beyond said boundary.
  • Count No. 21:  Failing to comply with Condition 5.1, between the 9th August 2022 and 10th August 2022, in that effluent emitted from emission point reference number SW1 which did not comply with the emission limit values specified in Schedule B of the said licence.
  • Count No. 23:  Failing to comply with Condition 5.1, between the 1st September 2022 and 30th September 2022, in that effluent emitted from emission point reference number SW1 which did not comply with the emission limit values specified in Schedule B of the said licence.
  • Count No. 30:  Failing to comply with Condition 5.1, on the 19th August 2022, in that cooling water/condensate emitted from emission point reference number SW2 which did not comply with the emission limit values specified in Schedule B of the said licence.
  • Count No. 34:  Failing to comply with Condition 5.1, on the 14th September 2022, in that cooling water/condensate emitted from emission point reference number SW2 which did not comply with the emission limit values specified in Schedule B of the said licence.
  • Count No. 35:  Failing to comply with Condition 11.3, between the 2nd June 2022 and 3rd June 2022, by failing to notify the Environmental Protection Agency by both telephone and facsimile of an incident, as defined by the glossary of the said licence, as soon as practicable after the occurrence of the incident.
  • Count No. 47:  Failing to comply with Condition 11.3, on the 1st August 2022, by failing to notify the Environmental Protection Agency by both telephone and facsimile of an incident, as defined by the glossary of the said licence, as soon as practicable after the occurrence of the incident.
  • Count No. 60:  Failing to comply with Condition 11.5, on the 1st August 2022, by failing to notify Inland Fisheries Ireland of an incident relating to a discharge to water, as soon as practicable after the occurrence of the incident.
  • Count No. 62:  Failing to comply with Condition 5.3, on the 26th August 2022, in that emissions from the activities carried on at their site at the said location, resulted in an impairment of, or interference with the water quality of the River Lung.

Judge Connolly, having previously heard the evidence, convicted Aurivo Dairy Ingredients Limited and imposed fines on Counts 35 & 60 totalling €200,000 and took Counts 7, 23, 34 & 47 into consideration. 

The company were also ordered to pay €150,000 over a ten-year period to local community groups and Inland Fisheries Ireland for the promotion of the general amenity and health of the River Lung.  Agency investigation costs were also awarded.
