EPA Prosecutes Timoleague Agri Gen Limited (P0986-01)

On 4th February 2025, the Environmental Protection Agency prosecuted Timoleague Agri Gen Limited, Barryshall, Timoleague, Bandon, County Cork at Clonakilty District Court.

Timoleague Agri Gen Limited pleaded guilty to breaches of conditions of its Industrial Emissions Licence (P0986-01) by: 

  • Failing to comply with Condition 8.9.2, on or about December 2022, in that they failed to carry out digestate analysis at the frequency specified within the said Licence, namely every month where the said licensed installation produces more than 10,000 tonnes of digestate per year. 
  • Failing to comply with Condition 8.8.1, on or about the 30th of November 2022 and 31st of March 2023, by failing to ensure that digestate complied with the required quality standard, in that the impurity content of the digestate was in excess of the Digestate Limit specified at Schedule E within the said Licence. 
  • Failing to comply with Condition 8.8.3, on or about November 2022 and March 2023, namely they did not treat digestate that failed to meet the quality standards specified at Schedule E within the said Licence as a waste or reuse it in the process. 
  • Failing to comply with Condition 11.6, on or about 13th of July 2023, by failing to ensure that specified documents were accessible at the site, namely records of sampling analysis carried out in accordance with the requirements of said Licence. 

Judge Cody, having heard the evidence convicted the company and imposed fines of €2,500 on each of the charges, giving a total fine of €15,000.   Costs were awarded by Judge Cody.
