Project Abstract
My research will propose and consider the merits of this new climatic directors’ duty within each jurisdictions’ regime. It is hoped that this would bring much needed clarity to the law and increase its effectiveness at ensuring that climate conscious directorial decisions are made in light of the worsening impacts of climate change. Little work has been done on whether a new duty could be effective in the jurisdictions studied. Nevertheless, some authors such as Quinn are at expositional stages of research into the merits reinterpreting existing duties. My thesis develops upon this literature, with the multi-jurisdictional comparative exploration of the adequacy of a new duty being an area which has not yet received doctoral attention. Thus, in this regard my research will be a new contribution to knowledge in the field.
